Terms of Use

These terms govern your use of Daystride, a free iOS step-tracking app published by TK MEDIA S.à r.l.-S, and the daystride.org marketing website. By installing or using Daystride you agree to these terms.

2. The service

Daystride is a free, on-device step-tracking app for iPhone. It reads daily step counts from Apple Health and shows them with a goal ring, a 7-day strip, and a simple history view. There is no account, no backend, no in-app purchase, and no subscription.

3. Licence to use

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Daystride on Apple devices that you own or control, for non-commercial purposes, in accordance with these terms and with Apple's standard end-user licence agreement.

4. App Store

You acquire Daystride through Apple's App Store. Apple Inc. and its subsidiaries are not a party to these terms; however, Apple is a third-party beneficiary of these terms and may enforce them against you. Your relationship with Apple is governed by Apple's terms.

5. No medical or fitness advice

Daystride is a general wellbeing app. The step counts and goal-related copy it shows are for informational purposes only and are not medical, diagnostic, or fitness advice. If you have a medical condition, consult a qualified professional before relying on any movement-related signal in the app.

6. Acceptable use

  • Do not reverse-engineer the app except as permitted by law.
  • Do not attempt to access non-public APIs, modify the binary, or redistribute the app outside the App Store.
  • Do not use the app or this website in a way that would breach applicable law.

7. Intellectual property

All rights in the Daystride app, brand, and website (including source code, designs, copy, and the "Daystride" name) are owned by TK MEDIA S.à r.l.-S or licensed to it. Nothing in these terms transfers any of those rights to you.

8. Service provided "AS IS"

Daystride is provided "as is" and "as available", without warranties of any kind, whether express or implied — including without limitation any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, accurate, or compatible with future versions of iOS.

9. Limitation of liability

To the fullest extent permitted by applicable law, TK MEDIA S.à r.l.-S, its directors, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, loss of data, loss of goodwill, or other intangible losses arising from or related to your use of Daystride.

9.1 EU consumer rights

Nothing in these terms limits or excludes liability where it cannot lawfully be limited or excluded — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under Luxembourg law. If you are a consumer resident in the European Union, you retain the protections of the mandatory consumer-protection law of your country of habitual residence.

10. Changes to the service or these terms

We may update Daystride and these terms from time to time. Material changes will be reflected by updating the effective date above. If a change materially reduces your rights, we will use reasonable means to draw your attention to it. Continued use of the app after a change becomes effective constitutes acceptance of the updated terms.

11. Termination

You may stop using Daystride at any time by uninstalling it. We may terminate the licence in this section if you materially breach these terms; the disclaimers and limitations of liability survive termination.

12. Governing law and jurisdiction

These terms are governed by the laws of the Grand Duchy of Luxembourg, without regard to its conflict-of-law provisions. The courts of Luxembourg City have exclusive jurisdiction over any dispute arising from or related to these terms, except where mandatory consumer-protection law of your country of habitual residence provides otherwise.

13. EU online dispute resolution

The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution before a consumer arbitration board.
